Rule 3
Exercise of Jurisdiction of Tribunal
(1) The jurisdiction of the tribunal will be exercised by all three members collectively. However, a bench with one member present can process the case and a bench with two members can process and settle the case. (2) In a bench with three members present, one vote of all three members or two members If the majority prevails, that vote shall be considered as the decision of the tribunal. (3) If there is no unanimous vote in a bench with two members present, in case of action, it shall be done in accordance with the opinion of the chairman in case of a bench with a chairman and in accordance with the opinion of a senior member in the case of a bench without a chairman. In the case of the judgment of the case or the final order, the opinion submitted to the absent member and supported by him shall be considered as the decision of the tribunal. (5) Cases submitted in accordance with sub-rule (4) shall be heard by the Supreme Court with priority.
